1. General
1.1 These terms and conditions are applicable to all agreements you conclude with Anne-Claire Petit BV, hereinafter referred to as ACP.
1.2 By placing an order you accept the general terms and conditions.
1.3 ACP is entitled to refuse an order, stating the grounds for doing so, or to attach special conditions to the delivery.
1.4 The agreement is concluded the moment ACP confirms your order by e-mail.

2. Contact
2.1 The ACP webshop is part of Anne-Claire Petit BV, a registered trademark and listed as such in the trade register under number 34257356. VAT number: NL 811158275 B01

2.3 It is not possible to visit us at the head office. From Monday until Friday you can reach the office from 9 am until 5 pm on the following phone number +31 (0) 206792338. On Saturday, Sunday and on holidays the office is closed.
2.4 You can send an email at any time to webshop@anneclairepetit.nl. We will contact you as soon as possible.

3. Prices and costs
3.1 The prices in the webshop include 21% VAT.
3.2 Prices listed in the webshop exclude shipping costs.
3.3 We are able to ship worldwide. However, the webshop allows only orders within the EU. If your delivery address is outside the EU and you would like to place an order, please e-mail us your contact details (including; delivery address, invoice address and phone number) at webshop@anneclairepetit.nl and the products you would like to order. Transport costs will be calculated according to your delivery address. Duties and import taxes are the responsibility of the customer to pay. We cannot split an order to separate shipping addresses.
3.4 For the EU the shipping costs are calculated automatically and are charged for every order. For EU order we ship with transporter DPD. ACP charges the following:

3.5 All prices are under reserve of misprints and printer’s errors. ACP will not take any responsibility for the consequences.

4. Product Information
4.1 All products of ACP are hand-made. Therefore each item is unique and may vary slightly in size or color.
4.2 Our products are produced in China, Thailand and Nepal. Expertise and working conditions are of great importance to us. We really appreciate the specialized handwork they do and pay them accordingly. We do not use child labor. We ensure that the workers we employ are treated properly and are not discriminated in any way. Our crochet teams in China and Nepal work from home. Their specialized handwork is part of their cultural and craft heritage. Our team in Thailand works in a clean and spacious atelier.
4.3 We do our utmost to ensure that our toys and products comply with our own high standards as well as the European and international legal standards. All toys are CE tested for Europe and outside Europe (Japan and USA). Please find specification per product in the webshop.

5. Delivery
5.1 ACP takes the greatest care when receiving orders and shipping the ordered articles.  We send the accepted orders as soon as possible according to the order of arrival.
5.2 Articles will be delivered within 3 to 9 working days after payment has been received.
5.3 If articles for some reason cannot be delivered at all or in time you will be notified accordingly no later than 7 days after placing your order.
5.4 We are not able to offer gift wrapping service.
5.5 The delivery will be sent with a packing slip and without an invoice. The invoice will always be send separately by e-mail.
5.6 As soon as your order leaves our warehouse you will be informed about the delivery. We will send you the tracking number of our transporter, which allows you to trace the parcel.
5.7 The stated delivery times are not binding, but are an indication of the estimated delivery period. Delays in delivery do not constitute grounds for termination of the agreement. ACP is not liable for any damage caused by exceeded delivery periods.
5.8 After the third time of your order being failed to deliver by our transporter the order will be sent directly back to us. If you wish the order to be resent, additional shipping costs will apply.
5.9 Incorrect delivery addresses or delivery addresses lacking information are the responsibility of the buyer and may result in additional costs.

6. Right of withdrawal
6.1 A reflection period of 14 days is applicable to your purchases. You have a right of withdrawal during this period. If you decide to return the articles, you will have to contact ACP by e-mail (webshop@anneclairepetit.nl). The products must be returned unused, undamaged and in the original packaging accompanied by the order number. We can only accept the return when the sender of the returned items can be identified and when conditions as described above are complied with. After given approval, we will transfer the amount to be reimbursed (minus shipping costs) to your bank account within 14 days. The shipping costs incurred for returning these articles will be borne by you.
6.2 If you receive an incorrect article, an article containing hidden faults or an incorrectly delivered order, please contact ACP by e-mail within seven days after the purchase (webshop@anneclairepetit.nl) and if necessary include a picture of the product. After given approval, we will ask you to return the article in an unused state, undamaged and in the original packing accompanied by the order number. ACP will replace the article and send it to you without any additional charges. In this case ACP will also pay you the return costs.
6.3 ACP always tries to resolve problems or complaints in consultation with the customer and in the best possible manner.

7. Transport guarantee
7.1 If you notice that the packaging of your parcel is damaged before opening it, please contact ACP immediately. If you have already opened the package at the moment you notice any damage, please contact ACP within no longer than 7 days. If you contact ACP by e-mail (webshop@anneclairepetit.nl) please attach a picture to it.
7.2 ACP always tries to find a solution to replace unused or damaged articles. If you contact ACP after 7 days the damaged articles will no longer be replaced.

8. Privacy
8.1 By placing an order you permit ACP to use your personal data if required. Your personal data will be registered in the customer file of ACP. This implies that in addition to carrying out the agreement, your e-mail address can be used for realizing marketing objectives and maintaining the customer relationship with you.
8.2 The personal data provided by you will not be shared with a third party for commercial purposes.

9. Payment
9.1 In the webshop you can pay by means of; the iDEAL payment system (Netherlands only), Paypal, Visa/Mastercard, Bancontact/Mr. Cash (Belgium only) and Sofort Banking. For payments with Bancontact/Mr. Cash and Sofort banking we will charge €2,50.
9.2 All transactions that occur via the webshop are encoded for your safety.

10. Liability
10.1 ACP does not accept any liability in relation to you for any damage, other than the damage that is covered by its liability insurance and insofar as the insurance company effects payment in such cases.
10.2 Outside of the aforementioned cases, ACP’s liability is always limited to no more than the amount of the purchase price of the relevant articles.

11. Force majeure
11.1 The obligations of ACP will be suspended in a situation involving force majeure. Situations that involve force majeure are strikes, illness among personnel, disruptions in transport and import/export bans, irrespective whether this occurs at ACP or the suppliers of ACP.
11.2 If the period of force majeure is longer than two months, both you and ACP are entitled to annul the agreement without any obligation to pay compensation.
